Problems of the application of extradition in light of the current international and national practices

December 19, 2012 will hold a roundtable "Problems of the application of extradition in light of the current international and national practice"

Read more: Problems of the application of extradition in light of the current international and national...December 19, 2012 at 14:00 in the room 3-10.  International Law Department of Law Institute SFU with Krasnoyarsk regional department Russian public organization "Association of Lawyers of Russia" will hold a roundtable "Problems of the application of extradition in light of the current international and national practices."

At the roundtable session will discuss:

  • grounds of extradition (treaty, reciprocity, the choice of the contract with the participation of a few);
  • the grounds for refusal of extradition (in light of the obligations of States to respect human rights);
  • criminal procedure matters of extradition.

 

During the round table, the participants plan to present papers and discuss the Resolution of the Plenum of the RF Armed Forces from 14.06.2012 "On the practice of the courts of issues related to the issuance of persons for criminal prosecution or execution of sentence, as well as the transfer of persons to serve their sentence," the new law of the European Court of Human Rights and the Human Rights Committee.

A more detailed program indicating the topics of the participants’ papers will be made up later.

International conference in Vologda

 In the work of scientific forum took part the head of the criminal procedure chamber of the Law Institute of SFU, associate professor, the chairman of the Public Council of the Russian Federal Penitentiary Service in Krasnoyarsk region A.D.Nazarov. He made ​​a report, in which in addition to the criminal procedural problems he presented booklet about the project "Step Forward" of the Law Institute of SFU and made a video about innovations in the penal system in the Krasnoyarsk Region.

In the work of conference also took part scientists of criminal procedure from Ukraine and Kazakhstan.

All the participants have listened with the interest report of Ukraine’s representative. From the 19th of November 2012 came into force the new Criminal Procedure Code which eliminates the step of instituting criminal proceedings and tells about a single electronic register of pre-trial investigations. Also new Code introduces the concept of "criminal offense"; eliminates the Institute of direction the criminal case for an additional investigation by the court; refuses the institute of giving oneself up, for the operational staff not to have temptation to use illegal methods of clearance of crime. It introduces a procedural figure of investigating judge, to much use house arrest control by electronic bracelets, surety, bail, etc. and to use such measure of restraint  as  taking into custody only as an exceptional event.

The experience of Kazakhstan’s legal procedure is interesting in the part of not falling under the jurisdiction of the European Court of Human Rights and focuses on the best models of criminal justice in Europe and USA.

Vologda’s land is the land of ancient monasteries and many churches. Even the first Russian colony for persons sentenced to life imprisonment located in a monastery on the Fire island. Recently in Vologodschine happened unique emergency: from colony 17 using a helicopter, which hovered over the institution was made a bold escape of a dangerous convict.
